INTRODUCTION

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER OR USING OUR WEBSITE. BY ACCESSING OUR WEBSITE OR PLACING AN ORDER, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

These Terms & Conditions govern all purchases made through Festival Hot Sauce (“Company,” “we,” “our,” “us”) and apply exclusively to orders shipped within the United States of America.

1. ELIGIBILITY AND ACCOUNT REGISTRATION

1.1 Age Requirement.

You must be at least 18 years of age to place an order or create an account on our website. By using our services, you represent and warrant that you meet this requirement.

1.2 Account Accuracy.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

1.3 Account Security.

You agree to notify us immediately at support@festivalhotsauce.com if you suspect unauthorized use of your account. We are not liable for losses resulting from unauthorized account use if you have failed to notify us promptly.

1.4 Account Termination.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period, with or without prior notice.

2. PRODUCTS AND DESCRIPTIONS

2.1 Accuracy of Descriptions.

We strive to display our products as accurately as possible. However, we do not warrant that product descriptions, images, ingredients, or other content on our website are completely accurate, complete, or error-free. Colors may vary due to monitor settings and photographic lighting.

2.2 Ingredient & Allergen Information.

All ingredient and allergen information is provided for general reference. It is your responsibility to review all ingredient lists carefully before purchasing if you have food allergies, dietary restrictions, or medical conditions. Consult a healthcare professional if you are uncertain whether a product is suitable for you. Festival Hot Sauce is not liable for adverse reactions resulting from failure to review product information.

2.3 Product Availability.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or substitute items of equal or greater value when necessary. We will notify you if a substitution is made.

2.4 Limited Edition & Seasonal Products.

Certain products are offered on a limited or seasonal basis. Availability cannot be guaranteed beyond the dates advertised.

3. PRICING AND PAYMENT

3.1 Pricing.

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. The price charged will be the price displayed at the time your order is confirmed. In the event of a pricing error, we reserve the right to cancel affected orders and issue a full refund.

3.2 Taxes.

Applicable federal, state, and local sales taxes will be calculated and added to your order total at checkout based on the destination address and applicable law.

3.3 Payment Methods.

We accept major credit cards (Visa, Mastercard, American Express, Discover), debit cards, PayPal, and other payment methods displayed at checkout.

3.4 Payment Authorization.

By submitting your order, you authorize us to charge the full order amount to your designated payment method. Your payment information is processed by a PCI-DSS-compliant third-partypayment processor. We do not store complete card numbers.

3.5 Failed Payments.

If payment is declined or reversed, your order will be held or cancelled. We are not responsible for delays resulting from payment failures.

4. ORDERS AND ORDER FULFILLMENT

4.1 Order Confirmation.

After placing an order, you will receive a confirmation email summarizing your items, pricing, and estimated delivery. This confirmation does not constitute acceptance of your order – acceptance occurs when your order is shipped.

4.2 Order Cancellations.

Orders may be cancelled within 1 hour of placement by contacting support@festivalhotsauce.com. After this window, orders may already be processed and cannot be cancelled.

4.3 Right to Refuse Orders.

We reserve the right to refuse or cancel any order for reasons including suspected fraud, pricing errors, or product unavailability. If your order is cancelled after payment, a full refund will be issued to the original payment method within 5-10 business days.

4.4 Bulk and Wholesale Orders.

Special terms apply to wholesale or bulk orders. Please contact us directly at wholesale@festivalhotsauce.com for pricing, minimums, and terms.

5. SHIPPING AND DELIVERY

5.1 Shipping Destinations.

We ship exclusively within the contiguous United States and to Alaska, Hawaii, Puerto Rico, and U.S. territories where carrier service is available. International orders are not accepted under these Terms.

5.2 Shipping Methods & Carriers.

Available shipping options and estimated delivery times are displayed at checkout. We partner with USPS, FedEx, UPS, and other carriers at our discretion.

5.3 Shipping Timeframes.

Estimated delivery times are provided by carriers and are not guaranteed. We are not responsible for delays caused by carriers, weather events, natural disasters, or other circumstances outside our control.

5.4 Processing Time.

Orders are typically processed and shipped within 1-3 business days of order confirmation, excluding weekends and federal holidays.

5.5 Shipping Costs.

Shipping fees are calculated at checkout based on destination, package weight, and selected service. Free shipping promotions are applied automatically when qualifying thresholds are met.

5.6 Address Accuracy.

You are responsible for providing an accurate and complete shipping address. We are not liable for orders delayed, lost, or returned due to an incorrect or incomplete address provided by the customer. Re-shipment fees may apply.

5.7 Risk of Loss.

Risk of loss and title for items purchased from Festival Hot Sauce pass to you upon delivery to the carrier. If a package is lost or damaged in transit, please contact us and we will assist in filing a claim with the carrier.

5.8 Perishable Products.

Certain products may be perishable. We are not responsible for product quality if delivery is delayed due to incorrect address information, missed delivery attempts, or extended time in carrier possession beyond our control. 

6. RETURNS, REFUNDS, AND EXCHANGES

6.1 Return Eligibility.

Due to the perishable and consumable nature of our products, we generally do not accept returns of opened or consumed products. Unopened, non-perishable items may be returned within 30 days of delivery in original, undamaged packaging.

6.2 Damaged or Defective Products.

If you receive a damaged, defective, or incorrect item, please contact us atsupport@festivalhotsauce.com within 7 days of delivery with your order number and photographs of the issue. We will offer a replacement, store credit, or full refund at our discretion.

6.3 Refund Processing.

Approved refunds are issued to the original payment method within 5-10 business days. Shipping costs are non-refundable unless the return is due to our error.

6.4 How to Initiate a Return.

Email support@festivalhotsauce.com with your order number and reason for return. Do not ship any items back without prior written authorization. Unauthorized returns will not be accepted and may not be refunded.

6.5 Promotional & Discounted Items.

Items purchased at a discount, during a sale, or with a promotional code may only be eligible for store credit, not a cash refund, at our discretion.

7. PROMOTIONS, DISCOUNTS, AND LOYALTY PROGRAMS

7.1 Promo Codes.

Promotional codes are single-use unless stated otherwise, cannot be combined with other offers, and are subject to expiration dates and minimum purchase requirements as specified.

7.2 Loyalty & Rewards Programs.

If we offer a loyalty or rewards program, participation is subject to separate program terms posted on our website. Points have no cash value unless redeemed for eligible purchases.

7.3 Referral Programs.

Referral rewards are credited after the referred customer completes a qualifying first purchase. Fraudulent referral activity will result in forfeiture of rewards and possible account termination.

8. INTELLECTUAL PROPERTY

8.1 Ownership.

All content on the Festival Hot Sauce website – including text, images, logos, product names, recipes, graphics, and trade dress – is the property of Festival Hot Sauce or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws.

8.2 Limited License.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our website for personal, non-commercial purposes only.

8.3 Prohibited Use.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our website without our prior written consent. Unauthorized use may result in legal action.

8.4 User-Submitted Content.

If you submit reviews, photos, or other content to our website or social channels, you grant us a royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with our products and marketing.

9. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FESTIVAL HOT SAUCE PROVIDES ALL PRODUCTS AND SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FESTIVAL HOT SAUCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES – INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES – ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITYOF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
